I'm 17 going on 18 and my boyfriend is 44. We have been dating for almost 4 years. My guardian doesn't know about it, but I'm sure he has a pretty good idea. We have NEVER had sex. Is our relationship illegal? Could he get into any trouble just for talking to me?

If you live in different states, then yes he could get in trouble, because you are not yet 18. It all depends on if your guardian finds out and wants to make trouble. I would look up the age of consent in your area, because even if you aren't having sex, if he gets arrested and it goes to courts, some places they will use those same guidelines for any intimate relationship between two parties. Now once you're 18, it's legal no matter how you slice it.

First, ANY question on law needs to include your general locale as laws vary by area.
Second a 40 yr old many having a romantic relationship with a 13 yr old girl (you said you have been "dating" for 4 years). Is disgusting. Even if there isn't a sexual aspect. I can't conceive why a 40 yr old man would be interested in someone that young, except for pedophilia.
Third, until you are 18, you are under your parent/guardian's control. If they become aware of this relationship, then could forbid it and if he tries to continue get him in trouble.

Not a legal response, but honey, this man is a pedophile. He's middle aged, you're a child. The fact that you've been "dating" for 4 years, since you were 13, is just sick.
Tell your guardian what's going on. IMO, you don't need legal advice, you need help getting out from under this pedophiles thumb. He's grooming you. This isn't love, it's very very wrong.
