View Full Version : How to amend the 1040 to a 1040NR

I made the same mistake I filled a 1040a instead of a 1040NR.

I asked the IRS for a refund for SS and Medicare that were withheld by mistake but my petition was rejected because I filled the 1040A instead of the 1040NR

How do I correct this mistake? Do I send the 1040x?

Can someone help me?

First, you must amend the tax return, filing Form 1040X and attaching a properly-prepared Form 1040NR or 1040NR-EZ PLUS Form 8843. On the Form 1040X, you should specifically request that your non-resident alien status be restored.

Once the IRS processes the amendment, then (and only then) re-submit the Form 843 and 8316 with the necessary support documents to request the refund of the Social Security and Medicare taxes.

From start to finish, the process will take about NINE months.
