My husband is currently in jail & he has been given the chance to take a deal, instead of going to court. Since it's a violent crime it's a 15-10 to serve on the deal, but he has never had a violent crim before?

Hello A:

There's MORE to the deal than that. You SAY he's never had a violent crime before, as though you think he COULD go to trial, get convicted and be sentenced to LESS than what he's being offered...

Nothing could be further from the truth... If they're offering 10-15 years, if he's convicted at trial, he'll probably serve 25.

Normally a deal is offering 1/3 less than if convicted.
So much about the deal is how good evidence they have. If they have so much evidence, that there is no chance in anyone's mind he will be convicted, that is about the best deal he will get.

If he starts trial and looks like he has even a poor but some defence, they may offer or take less.

If he gets 15 years depending on where he is at, he will serve about 8 to 10 years if he can get parole.

But if they are offering 15, most likely as excon said, if he does not take a deal and they convict, he is looking at a 25 or even a 30 year sentence.
