My Child's father is not on her birth certificate and hasn't seen her in almost 4 years. The whole time she has been with me and he has only paid a few months of child support. I am now married to someone who has been the only father she has known and he would like to be able to adopt her. Me and my ex did go to one mediation but he refused to go to a parenting class so he was never put on the birth certifaicate. As well as he was given vist time with her and on one of his times to pick her up he never showed up or call and that was the last time he has been around. Does he have any say with my child now? Is there anyway we can go with my husband adopting her without his say?

Yes, he has rights.

Please read this sticky, and please ask if you have more questions --

He should not have had to take a parent class to be on the birth certificate ? Who said hat had to happen?

But yes, he has all the rights he was given in the current custody order and visitation order. He is not required to use them.

If he has not paid, what attempts with child support enforcement have you done ? How many times have you taken him back to court ?

But you will have to contact the bio father and get his permission for the adoption.

The harder you force him to pay child support, normally the easier it is to get them to sign

This is confusing. There is a child support order, but he has not been determined to be the legal father?
