3. On July 13th 2011, I the respondent came home from work and everything that day was nice and peaceful between me the respondent, the claimant and others. We were talking about stuff and being civil in front of the children and parenting our children together. We were invited by our neighbours Dave and Ashleigh to hang out at their place. While being at there place things seemed fine, the claimant was drinking and I the respondant was looking after the children. We were telling stories and having a good time like civil people do. Around 1:00 am on July 14th 2011 the claimant got up in front of people in the house and started yelling at my brother Bart and was telling him that he should get out of her house. Then she the claimant started yelling at me the respondent and was telling me the respondent that I am not allowed in the house, and she the claimant started stating that I the respondent am hitting her at home, we were all shocked about this because everything was fine 1 minute and next this. Then she the claimant stated that I the respondent have hit her now, she the claimant tried to convince some of the people to take her side but no one would. Then she the claimant grabbed the children and went home and called the police. My brother Bart went after her the claimant to calm her down and she the claimant started being nice to him and telling him to stay with her the claimant while the police come. When the police came I the respondent have stayed away from the house so I the respondent don't make things worse. My neighbour Ashleigh went to the house because I the respondent was worried and told her to check on the claimant, while the police was talking to the claimant. My neighbour Ashleigh came back and has told me the respondent that the police have asked the claimant to leave the house and that claimants Mom is coming to get the children because the claimant was not in her right state of mind and not capable of driving or taking care of the children. My neighbour Ashleigh has also told me the respondent that the claimant stated to the police that I the respondent am planing to kill her ex husband (Attached to my affidavit is a copy marked Exhibit B). Then why is it that I the respondent always do access exchanges of Wyatt from her previews relationship with her ex husband in a civil way (Attached to my affidavit is a copy marked Exhibit H). The reason is because the claimant always claims that her ex husband verbally abuses her (Attached to my affidavit is a copy marked Exhibit E, Exhibit G). So why is it that I the respondent have never witnessed such a thing, or is it simply that her ex husband trusts me more with his child Wyatt then he trust her the claimant because he does not want to deal with her mental illness, she the claimant also told me that I the respondent am isolating the claimant from people by making her stay at home, then why did she the claimant come out to the neighbours house that night.
4. The claimant has left the house with the children and her Mom. As she the claimant was outside and leaving, she the claimant saw me the respondent walk to the house and came after me to start more trouble. She the claimant started hitting the door and yelling, and calling me the respondent names, then why is it that if I the respondent am so abusive towards her the claimant, and yet she the claimant has no fear of coming after me the respondent, and is kicking and hitting the door and yelling at me the respondent (Attached to my affidavit is a copy marked Exhibit A). So I the respondent have called the police. Then I the respondent went outside the door and told the claimant not to drive impaired with the children in her car as she the claimant was driving away, so the claimant got angrier and came out of her vehicle and went after me again. I the respondent have told the claimants Mom to calm her down. Her Mom told me that she is going to take the claimant and the children to her house so she the claimant should cool of and that the claimant will be back in the morning. Then they left. When the police officer showed up, he has told me to call him if she the claimant comes back to the house to collect her belongings as she the claimant told the officer she was going to do that.
5. Sometime around December 2010 the police were called by the claimant for domestic violence to my residence, she the claimant has told them that I the respondent was verbally and physically abusive towards her, she the claimant always claims that everyone is physically or mentally abusing her (Attached to my affidavit is a copy marked Exhibit E, Exhibit G). Then I the respondent was arrested and put in jail over night, no charges were laid, she the claimant refused to write a statement and there was no physical evidence on the claimant that proved physical abuse. In the course of time the children protective services have been involved to investigate the incident, and the result was that the claimant told them that none of the physical abuse has occurred as stated by her the claimant in the beginning. The children protective services simply have closed the file as they have not found anything wrong. At that time the claimant has not applied for an Emergency Protection Order even as it was given to her as an option. If I the respondent was such an abuser why did she allow me in the house and around the children? And ever since the incident she the claimant has been harassing me and verbally abusing me, and using and abusing the power of the police in her advantage.
6. I the respondent am really concerned about my daughter Hannah because the claimant has mental health issues in the past where she the claimant was heavily medicated. Also the claimant has placed both of her sons with the dads as she could not take the stress of parenting due to her mental health issues (Attached to my Affidavit is a copy marked Exhibit F), also the claimant has told me the respondent that the Doctor has told her the claimant that if she the claimant has another child she the claimant should see him and go on anti depressant right away, which she the claimant didn't. I the respondent am concerned because the claimant has told me the respondent that at some point in the past she the claimant could not handle her sons Wyatt crying because of her depression (Attached to my affidavit is a copy marked Exhibit E) and she the claimant could not stop shaking him because he Wyatt would not quit crying. I the respondent am concerned because some times when my daughter Hannah is crying she the claimant yells at the child to a point when I the respondent have to pick baby Hannah up and tell the claimant to stop. I am devoted father to Hannah and I am usually with here 24 hours a day seven days a week. Also in the past the claimant has run off at camping event and leaving both of her children in my care, everyone was concerned because she the claimant went missing and she the claimant was not in her right state of mind. At that time, there was a search party dispatched by the RCMP and a STARS helicopter to search the area to find the claimant and she the claimant was found at a hospital, as the claimant tried admitting herself in because she the claimant was hearing voices and felt like killing herself. The claimant did see a doctor that day at the hospital, and the doctor had prescribed her with a dose of medication for her depression. After the incidence the claimant was ordered to have and see a counsellor or a psychiatrist. Which she the claimant did, and after wards everything was fine. The defendant is not on any medication at the moment and she the claimant is acting in a very strange way from time to time, like she the claimant has two personalities. I am concerned about the claimant safety and well being and Hannah's safety and well being. I don't know why the claimant is acting the way she is. She the claimant should seek professional help as she is not in her right state of mind at the moment.
7. The claimant and I the respondent separated on 14th of July 2011. I the respondent have been in Hannahs life since she was born, and I am her biological father. Me the respondent and the claimant have shared day to day care of Hannah my daughter since her birth. (Attached to my affidavit is a copy marked Exhibit D). When Hannah was born, I the respondent have taken month of work to help the claimant with parenting of the infant, after we have split the responsibility of parenting by the claimant parenting during the day and me the respondent parenting during the night. When Hannah my daughter has reached one she was able to sleep at night and we have shared parenting from day to day. I the respondent would parent half of the week and she the claimant would parent the other half. The reason was because the claimant decided to go back to work. So as I the respondent am self employed I could work my working schedule around the claimant working schedule. I the respondent have suggested to the claimant that she the respondent could stay with the infant full time, but the claimant refused because she the claimant told me that she the claimant will get depressed with the child just like she the claimant did with the previous ones. Then the claimant showed me an article (Attached to my affidavit is a copy marked Exhibit C) and said to read it and I the respondent will understand what she the claimant is experiencing at the moment. I told the claimant to get help and we will get through this, but the claimant refused. I have already attended two sessions of group cancelling to understand mental health issues and how to cope with this mater and what is happening right now, the claimant can attend the walk-in counselling sessions with me but only if it's her choice. They have advised me that I the respondent should keep on doing what I am doing, like being civil to the claimant and try to get her the help she needs, but this is really up to her the claimant. We live in a country where we have one of the best professional health care that is available to us, so I the respondent don't understand why the claimant refuses to get help.
8. I the respondent propose split physical and legal custody for time being, to work around both parents schedule. As the claimant is working and is hard for her to make arrangements. I am self employed, so I the respondent can be more flexible. It will give the claimant a chance to get the help that she needs with her illness, only if she the claimant chooses to do so. The child shall not be removed from the province of Alberta.
9. In conclusion I the respondent want to parent my child as much as I the respondent can, I want nothing more than the best for my baby Hannah. I the respondent love being a dad and take very good care of my child needs and wants. She Hannah is fed sheltered clothed and loved every day. I the respondent am a nurturing father who loves being home most of the time for the child. I the respondent will work hard with the claimant to raise happy, healthy, loving, honest child. I want nothing but the best for her future.
10. I the respondent am financially, emotionally and mentally stable. I the respondent feel baby Hannah will do wonderful, and grow up a great woman.
The next day she puled an EPO for claiming that I have told her 10y son that I was going to burn the house down that is not even in her care 90% of the time.
Exibits are peoples latters that have witnesed this path of distraction, her old child custody document with her signature claiming that I am a good father and parent the kids with her day to day.

Proof that you are a better parent by not just saying it, but by doing something about it

Start showing that you are a good parent but you can be better one, proof that you are.
