After serving 20 months in Federal prison, I have server 1 year of a 2 year probation sentence with no violations of any kind. I'm am 64 years old and have no criminal history prior to this. The Judge denied a motion from the Government and my Probation officer for any and all additional restrictions they requested.

There was a judgment of $30,000 entered against me to the IRS for back taxes but was to be owed without interest or penalty or any payment schedule. I am not required to work or find a job and Probation has not requested or collected any money.

How would I request early release. J. M.

I'd just write the judge a letter. He's the only one who can do it. It doesn't look like you'll have the support of your PO. What else is new?

Give the judge the same reasons you gave us, and ask him to consider your letter to be a motion. Send your letter certified, return receipt requested, and send copies to your PO and the prosecutor.

But, I wouldn't hold my breath. They don't like to do that in the ordinary course of events, and even though you're 64, a year left ain't NOTHING. If you want to increase your chances, you could hire a lawyer, but I still don't think that would do it.
