View Full Version : What can I do if my son doesn't come back to me on the day that was agreed on?

I let my son go with him father for two weeks and now his two weeks are over and he is supposed to be home but isn't what can I do about it? We were never married but he did sign the birth certificate. We also haven't went to court to have anything approved by a judge. Please help thanks.

Go to court and get an order of custody and do it on an emergency basis. Make sure you have proof the child was living with you.

Without a court order, he has equal rights. Unless you have some proof that he agreed to return the child, then he can keep him and file for custody. Whether he would get primary custody we don't have enough info to even guess.

Was he supposed to bring your son back or were you supposed to pick him up? How far apart do you live? ANY question on law needs to include your general locale as laws vary by area.

You should probably go file in court to forestall him doing so.

Perhaps a misunderstanding ?

So what is he saying ?

But since you have not been to court, and since he is on the birth certificate, he is equal to you with all the same rights.

You can go to court to get a order of custody
