View Full Version : How do I adopt my wife's child if bio dad won't sign papers?

The bio father doe's not pay child support in fact he is way behind in his payments. He don't pay for half of the child needs (medical dental, clothes for school). The bio father also has a restraining order on him so he can't come near my wife. Me and wife believe that the only reason he won't sign his rights over is to try to be in control of my wife. Also he don't work and when finds a job and they start taking money out of his check for child support he quits.

Most likely no it will not happen. You can hire an attorney and fight it in court asking for it to be taken away.
In many states merely not paying support or not visiting the child is not enough to take away rights.
Your local attorney will work with you to see if there is any chance a all.

Consult a local attorney. Only someone who knows the local laws and the mood of the courts can help you here. Generally the law is on the bio father's side in this case. But courts are interested in seeing children raised in loving, two parent homes. So they may be willing to terminate his rights.
