View Full Version : Father's abandonment: How can I get full custody?

My boys' father has not been in their lives for going on 2 years now. He last saw them in September of 2009 and has not tried to make contact since. He has not been in prison, rehab, or a ward of any sort during this period. We were never married, and neither of us were granted full and legal custody. How can I go about getting full custody?

Of course he would always have the right to file in court for visits, ( full custody does not stop that as I am sure you are aware) But you merely file for custody in court

You already have fully custody. Unmarried, the mother has full custody of the child until legal work and papers are put in place to state the fathers rights.
Is the father on the birth certificate? Has he been tested to be the father or not?
Bottom line is, in most states, until you or he gets the legal paper work in place, you already have full custody.
Some states are different however, so I would check into the state laws on custody
