Hi Guys, I have situation here.. I am doing job on F1 (OPT) now I wanted to file H1 so I can get tax benefit for tuition fees I am paying for my wife. On paper we are single we have not shown marriage yet, she came to US on F1 and her passport has her father name and our marriage is registered in India 2 year back. Now I wanted to show marriage here so I can save taxes and wanted to file H1 as my employer is ready to file. Please suggest me what I need to do..? Do I have to registered marriage here.?

Your marriage in India is recognized by the USCIS.

A more important question; did your wife disclose that she was married when she applied for her F-1 visa? if she didn't this could cause serious problems when applying for other change of status and definitely if you ever file for permanent residence.
