View Full Version : What are the procedures for filing a claim in small claims court

As you are aware, I indicated in a previous e-mail that I would be terminating all communications with you. I subsequently spoke to Earl and he claims to have advised you concerning the contents of my message to him related to those items you did not return. He further stated that he did not want to further involvement and that you had said you'd return the items I requested. Since to date, you have neither returned my things nor have you given me a date certain, this is to request the same. I am therefore forced to send this to you.

I do not want this to escalate any further yet am not going to let it go. The intense anger, hatered and animosity towards you grows the longer you don't return my things. You know me in this regard. If I need to escalate it further, I will. When I spoke to your mother, she also made comments about returning things that she had. You have chosen to go down this road and I can meet this with the same spirit of determination. Should you desire this, fine. I do not want any more animosity and do not want to take this any further into the gutter than it has already gone so let me know and/or return my things listed on the list to Earl including the chopping boards. I have already promised to my children and Charles that some those items hitherto would be sent to them.

I have absolutely no idea what you are talking about or, for that matter, who Earl is and who Charles is and what this is all about.

Do you think you are writing this to an actual Small Claims Court Clerk?

Agree what are they talking about ?

If you want to file in small claims court, you will need to go down to the court, file out the form, pay the fee.

And you leave out all of the story, all of the drama, you state only why they owe you the money, how much, nothing else

When you file in Small Claims court you need to point out to the judge what damages have occurred and put a price tag on the damages. You cannot sue for pain, suffering or mental anguish in small claims court over the non return of items by this other person,

Could you please redo your post so we can point out potential problems you may encounter in court.

This seems to be a personal message about something. I don't know if the OP is thinking this will reach the intended target or is asking for help in writing something for submission to a court. But there is no point in speculating what the OP is asking, lets wait for the OP to return and explain.
