Police charge me for shoplifting under 5000 in GTA Canada. Having finger print by this 28 July and court date by this 29 July. The charge is not convinced yet.

I am going to apply visitor extension for my dad. In application form they immigration asked to decalare that anybody from my family convicted or charged for any criminal offence? What do I need to reply here in the application form? Do I need to provide all information about charge or just ignore? I am charged for theft under 5000 but not convicted. I have a court date by July 29..

Also reply me that can I cross US Border on 29th with this charge? Am I going to get any trouble crossing the broder by border authority? My lawyer is going to go to court by 29th.

Please reply all these question soon.

You HAVE been charged so that's why you say in the paperwork. The arrest is already in the computers, I'm sure, so you will be found out.

If you ARE on the computer you may not be allowed into the US - it's pretty much case by case.

Why aren't you asking your Attorney these questions?

I asked my attorney. She said you could not be stop crossing US Border because you have a charge which is not convicted yet. Even after convicted you can enter US because it is just a theft charge.

I'm former US Customs - crossing the border is a privilege, not a right. You can be denied if that particular Inspector does not want you in the US.

I see a problem if charges are pending but your Attorney knows your case far better than I do.

If you already had an answer, why did you ask the question?

By the way do you know if I put I am charged in my dad's visit visa extension application, then CIC may refuse my application or no?

If you lie on a application, you can be refused for that. Plus looked at for other filings. If they ask convicted or charged, then that is what they want to know, did you ask your attorney what happens when they find you lied

If they find me I am charged after I declare in application, then they may refuse visa extend for my dad or no?
