View Full Version : How does someone evict a family member who does not play rent?

An elderly relative needs to sell her home. She has two sons in their 50s plus a daughter in law who live in the house. Rent is not paid. One son pays a small amount in board, etc. including clothes and personal care items. How does she serve legal notice. What is required?

It does not matter what the relationship is, the process to remove a resident is the same. However, that process depends on local laws. ANY question on law needs to include your general locale as laws vary by area.

Generally the process would be to deliver an order to vacate within 30 days. This order would be in writing and can simply say please vacate the premises by x date. If the resident refuses to leave by the deadline, then the owner goes to court to obtain an eviction order. Once the court order is granted, the resident has a few more days to vacate. If they are still there, then the owner hires a sheriff to physically remove them.
