View Full Version : Part time dad wants custody after 3 years of not being there.

I have an ex and with this guy I have had two children. My daughter who is now 3 and a half has never really gotten to know him and my son passed away at 6 months and this man only saw him 6 times threw out his life. He only sees his children when it is convenient for him or when his teenage girlfriend wants to play mommy. This past time he went from October to June with out having any contact at all with my daughter and now he is fighting with me about custody. I have tried taking her to see him and he.normaly is too busy to spend time with her. I have tried getting health and welfare involved as well as his family. But he will only spend time when he wants and he gets mad if I don't take her when he wants. And now he will only visit her if his girlfriend.can.come see her too. Can I file for neglect and abandonment on him because he only spends a few months with her then disappears again. He has been doing this her whole life. Now that she is 3 it is starting to affect her she will ask me " my daddy don't want me? " or " my daddy don't love me? " and she will cry I hate seeing my daughter in pain. Please help me... what can I do?

As what I know of family court. Abandonment can be filed to the court, a petition has to be filed, to change the family plan... It has to be for a certain amount of time not seeing the child, but it can be done, it just depends on the state of which you live. Have you checked with Legal Aid? Or a Guardian ad litem? For the best interest of the child? Those are always good to have in a case where the child is not being treated fairly and have a healthy relationship with the parent/s... Good Luck
