View Full Version : Early Termination Addendum to Florida residential lease

I have a Florida residential lease which has an addendum providing a choice of remedies upon early termination. When the lease was signed we check the box on the addendum which states the following: I/We agree to pay an early termination fee in an amount equal to one full month's rent together with the return of all rent concessions, the totalof which rent and concessins may not exceed two months rent, if I/We elect to terminate the rental agreement and the landlord waives the right to seek additional rent beyond the month in which the Landlord retakes possession.

The last part of this wording that refers tod "the landord waives the right to seek addtional rent" concerns me. When I read Fl statute 383.595, I thought this kind of early termination addendum would eliminate the possibility that the Landlord may be entitled to any rents due in the remaining term of the lease.

This wording appears to give him the right to do so unless he waives that right should be choose to terminate early.

Can you provide some clarification?

It basically says you agree if he agrees. Most lease have no early remedy and rely on state statute for remedy which can be a great deal more. If you are thinking of terminating you really must approach the LL. You could be on the hook for all rent until he rents to another tenant which could be the full term of the lease.
