Can a father after 5 years and is on birth Certificate go to court to have child's last name changed to his instead of mother

Can a father that's on birth certificate after 5 years take mother to court to get child's last name changed to his instead of mothers after having joint custody but never married and father gets child every other weekend & pays child support?

If the child was given a last name on the BC, that well may have been the prerogative of the mother (Depends on the law of whatever state it is.), but in any event it would have been his obligation to raise the issue promptly. If he has joint custody, he should have raised the issue when the custody decree was decided, and not have waited five years.
