JASMINE2, you dragged up someone else's old thread from January. You should have started your own question.
Divorce has no set 'requirements.' You sue for what you want, usually with the help of a lawyer, he sues for what he wants (or doesn't want to give in this case), usually with a lawyer, and the judge decides. Your lawyer will show you how alimony would affect your disability payments too, and you need to start looking into public housing and other options if you and he don't own a home.

First its not a good idea to piggyback your question on someone else's. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread.

Second, ANY question on law needs to include your general locale as laws vary by area.

Spousal support is based on many factors dictated by local laws. So we can't give you an answer without knowing all those factors (which we don't really want to know). Your best bet is to contact a local attorney who can advise you.
