Hi All,
I have secured an offer letter from a big US company.
I have a criminal case running in an Indian court.
I have procured a No-Objection Certificate from the
Court for employment related foreign travel.
Do you think my H1B will be application will be rejected outright or is there some chance? I will be grateful for your comments and help.

It depends on the nature of the crime.

Yes, it will depend on what type of crime, and if you are convicted or found not guilty.
Also does this company know about this charge, since the job offer ( or job if hired) could end when they find out

The actual crime is not serious but the applied provisions of law are serious.
I have not informed the company yet. Their form had a box for convictions and not arrest. So clear that way.
What do you think?

And the case is running, so no decision yet has been taken. In India its common for a court case to run for 10-15 years.

If the crime is not serious, it may be treated as a misdemeanor or possibly even a statutory (civil) offense. Hopefully it is not a drug-related, firearms or crime involving moral turpitude. Good luck.

Its not drug/weapons related but might trigger morality questions. I guess the interviewer will have to decide.
