If I was in a car accident in the state of Ohio that was NOT my fault but my car insurance had lasped so I wsa not covered at the time of accident. Does that mean that the other drivers insurance will not pay for the damages?

No. Your insurance pays for damages YOU cause and damages to YOUR vehicle.
Has the other driver's company admitted guilt?

It was the other drivers fault he was sited for the accident I was not. Both vehicles are totaled.

No - as long as they agree that it was their client's fault and they agree with the cost of repairs they should pay. You will have to do all the negotiating with the other insurance company yourself. And of course you need to reinstate your own insurance ASAP, or risk tickets, fines, and (possible) loss of license.

The fact that the other driver received a citation and you did not is not proof of fault.
What did the "other" insurance company say? Did it admit liability?

I was trying to get the insurance put back on it the morning the accident happened, was waiting for the agent to call me back as matter of fact... the timing was of this was horrible. This just happened this morning still waiting on the agent so I don't even know if its worth it to still go through with it or not

You can't insure a vehicle if you don't own a vehicle.
Were you driving knowing you had no insurance?
