Can my husband still get unemployment if he was in jail for only 5 days. He was getting unemployment when he went to jail

Are you asking if you can collect for the 5 days he was in jail?

If so, no, he cannot. He has to sign that he was ready and able to take employment. He was not. He was incarcerated.

He is out now but can he file his claims 4 this week since he got out last Friday.

Does one have to certify that he is available for work 7 days a week, 24 hours a day? I think not.

Actually, if he is out of jail for a part of a week, depending on the UI regulations for the particular jurisdiction, he may be able to look for work during the remaining two days, and file a claim.

It is not clear what you are trying to say.

Your husband ended up in jail because your son was going to file the unemployment claim for your husband? That doesn't make any sense.

What did you tell the authorities?

My husband went to jail from may 9th to the 13th. My question is can he now get unemployment since is out. My son told me he was going to file my husband my husband unemployment that is why I called them, did not want my husband get into trouble.

Every week you are required to certify that you were available for work. If you were not available for work , then you file stating your weren't available. The next week you file that you were.

They told my husband to keep filing while they investagate to make sure he is out of jail.

He can file, but they have to check the box that says he was not available to work, if he checks the box that says he was that is fraud and can make him lose future rights

If your son was thinking about filing for your husband, the son should be aware that he (the son) could get in trouble for doing so. Again, depending on where you are, usually only the person who is out of work us allowed to claim UI benefits.
