View Full Version : Adopting when the father won't acknowledge the child

Okay guys, My son's biological father knows about our child. He was separated from his wife when I got pregnant and decided to work through things with her and deciding to ignore our son. It has been 100% his decision to neglect and ignore this child and has, in fact, stopped speaking to me as well. He has never paid child support and is not on the birth certificate. My husband is the only father he has ever known. How hard would it be for my husband to adopt my son in the state of Virginia?

Since laws vary greatly... what state, or Provence and what country are you in.

If the bio father will not acknowledge the child is is harder and will cost more. You will have to file in court for a DNA test to prove he is the father, Then after he is proved the father, you will ask him to sign over his rights to allow for the adoption. If he agrees ( or if he just refuses to show up in court) no problem.

OK. Maybe I termed that wrong. He will admit to being the father. When I said acknowledge, I meant he pays him no mind. He is also in Oklahoma. I have no idea where to start with that?

So will he agree to sign over his rights to allow the adoption ?

He won't talk to me at all.

You don't need to talk to him. Retain an Attorney, have the Attorney write him a letter explaining that your husband wants to adopt the child. The Attorney will enclose the necessary Affdavit for him to sign. If he refuses you husband cannot adopt your child.

Why haven't you ever filed for child support? It is not unheard of for the father to agree to the adoption in order to get out from under the support order.
