Can a mom leave the state with her child if no divorce has been filed

In general, yes, BUT it depends on the status of the marriage. Separation, in progress, something else?

Can the Court force the mother to return? Yes, under certain circumstances.

I think if you have the husbands permission. When I was like 3, (my parents were divorced) my mom took me out of state (MO to NY) for a year and when we came back, she lost custody of me. I'm 12 now, by the way.

I appreciate that you are trying to be helpful but we take great pride in our answers on the legal threads. They do not operate like the other "what do you think" threads.

Without knowing the status of the custody/visitation papers, the status of the marriage AND the State it is impossible to know.
