MJZ Construction performed over a 100 jobs in this time and each job was over seen by me and I'm proud to say that each one of these jobs got done exactly how they were contracted to. MJZ Construction never saw a court room from a client or even had a complaint filed against. I took pride in getting the job done exactly how agreed upon and would take a lose before an unsatisfied customer. 90% of my business was by referral so I always went that extra mile. This hard work and dedication was the backbone of this company and the reasons for its success.

Now I take full responsibility for the good and the bad with MJZ Construction because inevitably it is all my responsibility anyway but I always thought our taxes were filed monthly, quarterly, and yearly, which they were, but I guess some of them were missed.

Also at the same time I was having health issues, I came down with 3 bouts of MRSA and N1H1 from July to October and a possible nervous breakdown. Non the less on October 19 2009 I got shut down for 14k. Which the way that happened was just as suspicious as all the $$$ that I was told I owed plus I never got a letter stating how much and why I owed this $$$. The day before my court date I got a letter from the state's atty (John Ritter) certified mail, and it stated that my court date was moved 2 weeks down the road. The next day Betty called me and told me because I missed my court date that my licenses were stripped and I could no longer do business in SD or be 1099 or I would go to jail. My next call was to the judge whom I was to see and I spoke with his secretary and faxed over the letter I received. What I found out was that the letter sent to me, was for a different company...
> After that I could no longer fight for my company and let go. In the months to follow I lost everything I had and I voluntarily repo'ed all my equipment and trucks, contact all my creditors and personally give my labor for free just to finish the jobs I was on. Even my landlord I gave free labor to because I couldn't pay rent. I screwed no one over I did everything as a stand up guy for my kids and friends to see who I really am. I lost everything I had to realize that everything I have, can't be taken from me, meaning my family is the most important thing to me.

My charges are; Failure to Pay Contractors Excise Tax (SDCL 10-46A-1.8) and (SDCL 10-46A-13.1(2)), five counts: and the crimes of (SDCL 10-46A-13.1(7)), two counts; having been committed and accusing me, dba MJZ Construction & Design. Plus, it's the attorney generals office that prosecuting me.

Many a 'great gal' (or guy) running the office has no clue about taxes.
I realize that you do admit that is your fault.
I don't understand why you aren't running around various state offices, or if they are far away why you aren't actively working on this debt rather than waiting for them to charge you with a felony.

I don't understand how subs become employees because they didn't pay taxes. They are subs because they meet the IRS criteria for self employed, which you determine, and then you issue them 1099s. If the IRS decides they are employees, you owe a whopping amount of payroll tax.
WHERE DID ALL YOUR PROFITS GO? Now you are in public housing? Was it a million dollars gross over 3 years, which isn't very much in the building trades, what with all the expenses?

Your best bet is to hire an ex IRS agent who specializes in shmoozing down your bill for you. Their fee will be less than your savings - it's worth it and vital.
I know you have no money. Beg borrow don't steal and hire someone. The feds will be after you too.

You need some serious legal/professional advice. Why did you list all of your personal information in this post; not a good idea. Take it down immediately. Something went terribly wrong here... and you've got to seek help immediately.

I agree with EmbracingPose. Contact admin and have them take this post down; you have provided too much personal information.

Then contact an enrolled agent who is practicing locally to help you with this problem. It is MUCH too complex to be handled over any forum of this nature.
