View Full Version : How can I proof I didn't Abandom my home?

My wife cheatde on me and she decided to leave the house we purchased during our 10 year marriage, we have a 4 yr old girl which she only let me see if whenever she wants, she doesn't event let me stay with her over the weekend. The house is under her name only.

We have been separate over 1 and 5 months, during the first year in 2009 I stayed and care for the home, but since I was going through a very very bad financial hardship, in January 2011 I decided to look for a better opportunities in another state so that I can pay for all the bills.

My Mortgage was already 3 month behind and my wife called me to see if we can rent the house. I told her it was a very great idea, that way we can pay for the mortgage with the rent. Since the mortgage was behind, I told her to sell my personal belonings to pay for the mortgage that was behind. I also verbally agreed with her that any overage from the rent of the house, are to be use to pay for the bills we owed. She had sold all my personal property and paid for the mortgage which it was behind, there was some repairs that the house need it that she paid but I told her that I will pay for it. She asked me to place the water under my name until the house was ready for rent, which I did, but now, she wants to accused me to abandoning my house and claims that I left everything behind.

She hired an attorney and getting receipts to try to proof that she is paying for everything in the past 4 month. The hosue was recently rented and I sent her a money oder to pay for the expensive she paid to have the hosue ready for rent. I also paid for the cleaning of the house in order to be ready for rent.

Now she doesn't want to accept the money order because she wants to accused me of abamdoning my house and wants me to loose all my righs so she can move in with her boyfriend which is the same guy who she cheated on me with.

What are my rights in order to proof I didn't abandom my house. Since the hosue in under her name alone, but the house was obtaine during our marriage however, she didn't pay a single dime for the down payment or mothly payment or any bills,I paid for everything in the house, can she successfully accused me of abanding the house and refuse the money order.

Is she trying to prove abandonment so she doesn't have to share the house as part of the divorce? If you have any correspondence and documents that show you agreed to rent the house you should be able to disprove her claims.

So what papers have you filed in court for divorce

What child custody papers have you filed, she does not decide when and if you see the child, the court does when you file for your rights either to joint custody or at least visits.

I am filing to try to get costudy of my daugther because I want to be a father but I know that will take a long time, but in the mean time, what can I do about my home.
