View Full Version : Can I get custody even if baby's dad is on the birth certificate?

Myself and my now ex partener had a son together for the first few months he wouldn't see him then we reconciled and now after a difficult breakup again, he has recently left , in the few weeks he has been gone he hasn't shown any interest in our child i.e ringing, texting or wanting to visit. I am planning on filing for a residency order/custody asap and wandering realistically what the chances of me gaining custody are? I am a good mother and unlike his father do not get frustrated with him or keep walking in and out of his life but fear that if he chooses to be spitefull and fight the custody battle as he is on the birth certificate that I wouldn't have much chance . His father is now 220 miles away and shown no apparent interest in him but to hurt me would probably decide to do something if I did file for residancy order as unfortunately that is the kind of person he is wontshow any interest but if he ges the chance to try and hurt me will use his as a means ofdoing that. Please will someone give me a realistic idea of what the outcome could be ? Thank you

Obviously if he opposes your request for a custody order, all of what you have said will be relevant. Unless he has some evidence of facts you have not told us, you should have no problem getting primary physical custody. Are you also asking for an order that he pay you child support?

Huh? Where do you get that idea? Are you also on the BC? You are in the US, right?
