I had guardianship of 4 of my grandchildren from 2007 until 2010, due to my son and daughter in law going in and out of jail, domestic violence, drinking, drugs, and other problems. In 2010, my son went back to jail and my daughter in law got out and decided she was ready to raise the kids. We went to court, had our homes and lives investigated and a judge returned the children to her against all advice from CASA and DFACS. They wanted her to receive AA, Drug Rehab, and prove stability. They kids are 15, 8, 6, and 4. It has been 4 months since she got them back, and the oldest child is in trouble for drugs, and the kids tell me they are being mistreated by mom's new boyfriend and that mom is drinking a lot again and being mean to them. They cry every time the see me and beg to come back home to my house, where they were safe. No local authority will listen to me or them and I don't know what to do. The kids are in danger with their unstable mom and I want to get them back with me until she gets help for her issues, before something happens to one or more of these innocent children. Any advice? I live in Georgia, where I am told I have no rights as a grandparent. I raised them for a lot of their lives though.

I hate to just answer with "have you talked to an Attorney" BUT there are SOME Grandparent rights in Georgia.

Can you get them back? I don't know. An Attorney would.

I agree with JudyKayTee.
A lawyer will know what to present, and you may have a judge who simply prefers to listen to cases argued by lawyers. And perhaps this isn't so much a case of grandparents' rights as it is renewing the guardianship.
It wasn't unreasonable to give the mother a chance.

Thanks, I know the mother deserves a chance, but if she isn't going to work on her alcohol and drug issues, she should go to rehab, get straightened out and then try to raise her kids. This is what the court appointed advocate for the children suggested, but the judge didn't want to hear it. Why should the kids suffer because a judge made a poor decision? The children deserve to be happy and enjoy their childhood, not have to grow up so fast because of grown up mistakes.
