I have been petiotioned by the court in New Mexico regarding Child Support. All they want right now is to establish paternity. I live in Texas and can't miss work to appear in these hearings. 5 dryas ago, I got a "NOTICE OF HEARING" stating that I need to appear on May 26th.
So my question is What type of MOTION do I need to write up to?
1) to tell them I am going to need a continuance and/or phone conference hearing
2) most importantly to make it a state to state case so we can conduct matters over the phone and so I can get an attorney here in Texas to take my case. Because lawyers here won't take the case because they are not licensed in New Mexico.
I refuse to get a lawyer in Mew Mexico while I live here in Texas. I have done this before in another case in New Mexico and the lawyer pretty much ripped me off and never returned or answered any of my 100s of calls. He took the money an ran with it and pretended like he did something but still has never shown me proof. Even if I try to call him today, I still get no answer. So again my point is I will NEVER hire a lawyer who is not local due to past negligence.
So for now I am writing the motions myself because I am running out of time. ---> My question is: what would the Title of my Motion be? i.e. Motion to Dismiss, Motion for Paternity, etc.. And will I need to create two different motions? One for making it an interstate case, and one for a continuance and /or telephone conference hearing.
If you have any other advice or questions please feel free! I am open for any suggestions! I don't want to get screwed over by the state of New Mexico and the my ex!
