View Full Version : Is child support divided among ssi eligible children?

Both of my children are eligible for SSI and recently after two years their father was located and Child support garnished from his checks. When he filed taxes, they must have taken a larger amount than normal in February and the total monthly payment came to 530 dollars. This caused an overpayment. In the paperwork it seems to count the 530 dollars as if both of my children each received that much. I always thought that the amount of money received due to child support would be split evenly between them as if one child received 265 and the other received 265. Am I wrong?

Sorry, but I don't quite understand what you are asking. $265 x 2 = $530, so what makes you suspect that you have been paid more for one child than for the other?

The amount of the SSI benefit decreases if more money is received in the household. The total amount I received in February for child support was 530 dollars because they took an additional 300 dollars from him from his tax refund.

When factoring how much money each child receives for SSI, they factored in the 530 dollars for one child, then did so again for the other child. Each child did not receive 530 dollars. They both received it as a total.

To further clarify, I was wondering if that's just how SSI works, or if the lady working my case made a mistake and forgot to factor in that this 530 dollars was divided between two children.

I may not have explained that well this morning before I fell asleep. I was receiving 414 dollars a month for each child from SSI due to my income. OAG located my ex husband after nearly two years of child support piling up and his evasion of paying them due to leaving the state and he is forced to pay his monthly payment of 300 dollars plus 60 in interest until the 4000 dollars of accumulated child support is paid off to me. This is two payments of 180 dollars a month that I receive. The SSI representative has it figured as each child receiving an unearned income of 180 dollars which decreases their payment from 414 dollars. I was okay with that, but when the unexpected tax garnishment came they were reduced even further.

Because his debt was so great some of his tax return was garnished. I was given 530 dollars in the month of February instead of 360. Normally each child's statement says they receive an unearned income of 180 but this time it listed the amount as 530.
