This is second time getting caught for theft under $5000 and possession under $5000 and I'm now 20. The things I got was worth almost 600$ in total. . now I don't know if I'm going to get time or not.. I don't know anyone that has experience getting caught twice?? So they can not tell me.. what can go on in court.. I'm still deciding whether I should get a legal aid or lawyer.. or maybe I should just get duty council like the first time.. and what would happen to my daughter if I do go in? Please help me out

Your fist time that you were caught, how old were you?

If you were under 18, then you most likely were charged under the YOA, and upon your 18th birthday, your criminal record erased.

So technically, this is your first time in accordance with the law, and odds are you won't get any jail time.

However,
If your first time was when you were 18 or older, you might get jail time this time around.

Maximum sentence is 2 years.

Best advice: consult with an attorney.

Does this apply for canadian resident.. cause two year is a lot! Maybe that's just for the u.s

Your daughter will go to the closest family member, or a foster home. If you cared about her, you wouldn't have done what you did. You can only start over. Good Luck!
