View Full Version : How do I gain temporary custody of my niece and nephew from the state?

Hi, I live in Texas, am a single 36 year old woman.I have been in the same profession for many years. I live in a two bedroom house in a great neighborhood with amazing schools. I have been told almost no details from my brother on the progress of the case with my niece and nephew except he must complete classess and therepy for a year before he can possiably get them back same from the mother. We have not been able to see them, birthdays have passed and worse they are separating them. They have been through tramatic events and I want more then anything to help them. Not sure if they are even receiving therapy which I believe they so desparatly need.

Trying to fill in the blanks here - were the children removed from your brother's care by the State of Texas? Are they in the mother's care or were they also removed from her care?
Have you spoken to the children's case worker?
How long ago were they removed from the home?

My brother shared custody with my ex- sister in law, they made an outcry to my mother she took them to the hospital and since then it has been an ongoing spiral. My brother refused to return them after a judge ordered him to because he was fearful of the mothers ability to keep the offender away from the children. The state then stepped in and took them. They have been in the states custody since 1-8-11. I have no idea how to get the caseworkers name, my brother has shut down and is not talking to anybody. I have been to court and have waited outside because most of this has been held in closed chambers.I have tried to talk to his attorney and received no information.

I am assuming there is an allegation of sexual abuse?
