View Full Version : Tenants Legal Rights In Missouri

Please Help! I am a 52 year old female living in the same apartment complex since 2003. Over the years I have had 3 different apartment owners. I frequently have problems getting anything fixed or looked at by the managers or by anyone in mainenance and have paid out of pocket for plumbers, widow people etc... etc.. One summer I went without any air conditioning with temperatures in the 100's. My current problem is this... Recently a new apartment manager took over here. ( In the complex there seems to be an issue with keeping them. ) Every month for the past 4 months I have come home or opened my door to find a nasty letter either stuck in it.. which could blow away... or taped or in a bag. The problem is this... The letter threatens eviction and or commencement of action to the Circuit Court of the County where I reside, for non payment of rent. Subsequently, I am forced to take off work, Drive back home 15 miles.. Get my receipt of payment, go to the office, sit and wait while the assistant is either chatting on the phone or talking to a tenant while the apartment manager sits in her office on the phone. I loose 22 dollars an hour doing this.. and sometimes they are not even there... hence, more money lost.. gas.time etc. I have a serious heart condition. This added frustration, wage loss, time loss and aggravation isn't helping me. I even ended up in the emergency room in December 2009 over it. Do I have any legal rights because of this? I have lost almost a thousand dollars because of it since December of 2010. If I could move I would. Health issues and money do not allow me to do so.

Look. If this happens again, fax or scan and email your receipt, along with a letter DEMANDING they run their operation BETTER.

You have LOTS of rights, and you can make all sorts of demands upon them. What OTHER problem are you having??

You mean besides the Arson, stabbings shootings etc which have started in the last 6 months?. Funny:D But not funny... I'm serious here.
Holes in the parking lot that you can drive a Volkswagen into... Ironically I own a Jetta. Punctured tires and bent rims x2 from this... Car vandalized with broken passenger window x4 at 437 american. Broken arm in early 2010 due to non removal of snow and ice in their parking lot, along with a small ankle fracture.(Same incident) I could go on and on.

Please don't. It's just a sad story. If their negligence was the cause of any of your injuries, and you did NOTHING, then that's on YOU. All the other stuff just sounds like you live in a lousy neighborhood. How is management responsible for that??

Look... MAYBE they're really BAD SLUMLORDS who have been violating your rights and your lease from the get go. I don't know. But if you did NOTHING, shame on you.

You HAVE rights. In order to SECURE them, you FIRST off, need to know you have them, and SECOND, you need to know HOW to ENFORCE them. You don't know ANY of that. Start with reading your state landlord/tenant law. Those are the RULES you need to know. We have a copy of them at the top of the real estate page on a sticky note.

Finally, WHEN you are HAVING a problem is the time to ask people like us for help... We can't do anything about stuff that happened long ago.

I will read the sticky and look into the legal aspects of both sides of the coin. However I do feel that I hae the right to seek an attorney over the issues for the past 4 months. Posting things on my door which are visible to everyone (slander) Mental anguish related to harassment. Financial loss related to time, money etc. correcting the issue. As for not seeking assistance for other things in the past... Poo Poo on me. Better yet... stand over me... step on my neck... make me gasp for air then poo poo on me. LOL... I first try to see the good in people and understand that we all make mistakes... But stick a fork in me I'm done. Thank you for your response.

I don't think you have a case. But, you DO have the right to have a lawyer check it out. Let me know what you find out.
