Hi, I am an F1 student in Miami, Florida. I have been approved an OPT and worked for a company. I used a free income tax service and they filed the Form 1040. After that, I found out that I have to fill out the Form 1040NR or 1040NR-EZ as I am a nonresident alien. What can I do to correct the mistake? I am concerned about the issue that the form says that I am not a nonresident alien, though I told the tax preparer that I have an OPT. Is there something I can do about it?

Fabio:

Go back to the tax preparer and have him amend the return using Form 1040X and attach properly-prepared Forms 1040NR-EZ and 8843.

Mylapore:

There WILL probably be a difference in the refund.

If either of you need help filing the amendments, contact me at [email protected] or [email protected].
