Can I claim my attorney fees from a real estate attorney that I had last year. What the sisuation was that my husband and I purchased a house that was defective from the builder, but he was not going down easy to say the least. :mad: We had over a year of attorney fees and two years of fighting before we solved the problem. Can I claim these expense since it was a fight and not something that we expected?

"Claim" them from whom as what? As a deduction on your tax return? From the attorney who earned them? Against the other party?? I don't know. Any fees you wanted should have been included in the amount you reconciled for when you "solved" the problem. Does solve mean settled? You can't go back.
However, your post is not clear, so I'm left to guess. If I hit the jackpot on any of these answers, please forward my winnings to...

PS> (edited) My bad. I see in your title, that you want to deduct your legal fees on your tax return. I don't believe legal fees are deductable, but I don't really know. You need a TAX professional - not a legal one. We have one here, but you need to find him on the tax board.
