Ive been separated from my husband for two years he has never done anything for my daughter but call her all types of *****es and hoes and telling her to suck his **** and that she isn't **** and he is her real father how can I get his rights terminated I have all the evidnce on how he's been cruel toher

You can't. Basically you can only get a parent's rights terminated in two circumstances. The first is having a step parent ready to adopt. The second is if you can prove the parent is a danger to the child.

With what evidence you have, you may be able to get any visitation suspended, but not get his rights terminated.

Start with a restraining order. Then go from there. What evidence do you have?

I tried the restraining order and they were trying t give him visitation He has dogged her and been very cruel I have Voice mails and text messages of him saying all those nasty sexual things my baby can do to him and how he is going to kidnap her I will not allow him to be in her life

When you apply for the restraining order that is the only issue to be decided unless there are other separate issues in the order.

Were they moving to give him custody of what kind? Are we talking about supervised custody ?

Away is to have a step father ready to adopt her?Ok so telling his daughter to suck ****** and that he is not going to claim her and how he's ging to kidnap her he makes it pretty clear that he don't love like or care about my baby and in order for me to get his rights taking

They were going to grant him visitation rights like coming to get her for the weekends and holidays my thing is why would I send my baby with someone who has not done anything for her he didn't evn sign the birth certificate and treats her like trash I'm not having it I will not let him come get her she don't even know who he is and what type of guy would tell his own daughter something so discusting like that? Any man like that don't deserve to come get her what can I do to get his righs terminated other then a restraining order?

Second, yes, courts are VERY reluctant to issue TPRs and generally will not except under the circumstances I mentioned.

Who is the "they" that is trying to give him visitation? A restraining order is a separate thing from a visitation order. Have you presented the evidence you say you have to the court hearing the request for visitation?

You should forget about a TPR since its unlikely you will get one. You should be expending your efforts on what you can get which is sole legal and physical custody with no visitation. Do you have an attorney?

In getting the restraining order it is for your daughter. At that time as Scott is suggesting you can ask for sole physical custody. Im not clear as to why you ask for a restraining order of this magnatude and they are wanting to allow unsupervised visitation.

The restraining order is the first step in the process of court documentation and also to control what happens with your daughter.

From there you provide proof of harm.

Later if an adoption were to take place then his rights could be forcably removed.

TPR = Termination of Parental Rights.

If you don't have an attorney, especially if he does, that may be way you aren't getting what you want. Maybe its because you aren't presenting your evidence the correct way or you are antagonizing the courts, I don't know, but I would advise getting an attorney.

All right I'm going to get his rights terminated and going to use my evidence wisely he can't afford and attorney but I do have someone willing to adopt her so I will take it from there and I forgot to tell you that I already have sole custody sir

Sole legal or physical custody or both? There is a difference.

We want to help you but if you don't provide us with information we can't. I asked you several questions about his getting visitation which you haven't answered.

You can't just get anyone to adopt. Generally the courts will require you be married to whoever adopts.
