View Full Version : Did they make a mistake in nys when they released a man who has abused me to know end

They said he wasn't going to get a bail---he made bail 5 days later----shouldnt he have been on a PO hold the problem was he committed the crime in one county and ---they didn't catch it---or made a mistake and gave him a bail hearing----i thought he would get transferred to the county he's from----not get released and his PO told me he signed a paper last year that he wasn't going to go to the county he got arested in---what happened did the system fail to protect me----how did he get out----they made him report---and locked him up right away but he has a history of violence towards women---which I did not know until I spoke w his parole officer---whats the law ---does anyone know---for nys----can anyone suggest any other resources---or places I can get an answer---i spoke w the DA she says he had a right to get out on bail---that even murders make bail----what?? I guess my life just isn't important enough for the people who are supposed to be helping me---its not a career builder

First, its up to the prosecuting attorney to argue against bail. They use the nature of the crime, the filght risk of the accused and their criminal history to convince the judge that bail should not be allowed. It's the arraignment judge's decision as to whether bail should be allowed or not. And too often that decision is based on how crowded the jails are rather than the accused's danger to society.

Without knowing the nature of the crime, the history of the defendant, etc. Its hard to judge whether the judge's actions were correct or not. I can tell you that it is no reflection against you, but the realities of the criminal justice system.

Was a restraining order issued against him? If not the DA should go back and get one. In that way, if he violates the order, bail can be revoked.

Hi thank you for your input---it crossed my mind that the jails are over crowded---he has a past crimminal history of this and I got a restraining order when I filed the complaint---i can't help but take it personally--when he threatened me three times---which I proved----i just can't believe this---i finally stand up to this man and they let him go five days later----this man will stop at nothing---hes smart and knows how to manipuilate the system--thanks tough I just thought they said he wouldn't get bail because he violted parole and was a two time felon----great justice system

Yes, too many criminals have been through the system so many times they can manipulate it. Do you have a cell phone with a camera? If not, carry a small camera with you at all times. If you see him near you take a picture, make sure it includes a recognizable landmark so you can show that you had business being there, not that you try to get him to violate the RO. Then take the pics to your DA right away. You should have a cell phone with you at all times so you can dial 911 if you do see him.
"They" (I assume you mean the DA) probably told you he wouldn't get bail because they genuinely believed it. But they have no control over the arraignment judge. Again DO NOT take it personally. The judge made the decision without any regard to you.

When is the trial set for? Please keep us posted.

Hi thanks they adjurned the first date and the DA hasn't notified me of the second one---i am not sure if we are going to trial---but I will keep you posted----as always thank you so much---have a nice weekend--i've a cell w camera thanks good point about business---he's locked up in another county for violating parole--so I am safe for now----but we shall see----i have know idea when he's going to be free---omg sleepless nights---thanks

Hello and thank you--one and all for your help---i went to the parole hearing and I'm exhausted---he's being violated---i think---i guess they will notify me----it was a rough day---it was almost like being abused all over again---they needed my testimony---im so tired --but can't sleep---i found out this man has done this to several women---very scary----hopefully --he will serve his time and walk away from me forever---i just want to get on w my life and continue to be a productive member of society!! --live laugh.. love
