View Full Version : How to help do tax return jointly with my husband ?

I went to US work as L-1 since March 2010. My husband was F-1. He then came back to China in June 2010. Then he got L-2 visa in November 2010 but still do not have applied for SSN or ITIN. So:
1. Could I do tax return jointly with him ?
2. Do you have any checklist for tax return forms I need to input to do tax return jointly with him ?

1) Yes, you can file jointly with your spouse regardless of his physical location. He could be on Mars for all the IRS cares.

2) No checklist, but you will need to report his foreign income if you file jointly. That means also filing Form 1116 to claim the Foreign Tax Credit, which requires he file Form 1040.
