View Full Version : Violation of Probation- Battery

My newly EX boyfriend I dated for 3 years has been on probation for about two years for a multiple crimes he committed in CO. He was very vague about what he was charged with, he served 30 days in jail. All I know is what I've read online about his case.. potential robbery of electronics stores, domestic violence (from his previous relationship), and involvement in the destruction of his ex girlfriend's car. He was a fugitive, he ran down to FL where I live, and they came and picked him up and took him up to jail in CO.

During our relationship he was very abusive, after 2 years I finally decided to go to the police after I was hospitalized. The charge is battery, and the cops said they don't know if he will even be charged with that because I waited about a month after the last incident to come to the cops, and I might not have sufficient evidence. I have pictures from 3 different incidences, including this last one, and a recording of him saying that he did it to me. But of course, the recording can't be used in court without his consent.

If he violates his probation he is supposed to be sentenced to 4 years... what do you think is going to be the outcome?

First and this is going to be harsh, but did something not seem strange that after 3 years of dating, you did not know what crimes and all the details of what he did.

And of course to be rude again, the police expect in a week or two you will be back with him and don't want to waste their time doing much about a month old case.

At this point they will have a hard time even proving he was in the room with you wihen it happened, and more.
It would end up his word against yours.
Also your photos are not evidence, no way to prove they were not done with makeup ( like the movies) the police would have to have done photos, where the chain of evidence shows the photos valid

Have you called or went to the DA office and asked them about filing charges ?

No I haven't gone to the DA office, I was told to just keep calling the state attorney's office after they've filed the report to keep checking up on it's status and that that was all I could do.

As far as the pictures.. I can prove it wasn't done with makeup because I have documentation and x rays taken from the hospital, but you're right I can't prove that he was the cause of it.. except the recording I have, and the fact that he paid the hospital bill.. but once again I'm pretty sure he paid in cash so that is of no help to me. I don't know I'm just really worried that he's going to get off scott free and this will have all been for nothing.
