View Full Version : Can I sue my landlord after a breaking and entering if they came in through the attic

I've recently been robbed. The next door neighbor and/or friends went through there closet where there access to the attic which has open walk ways to my apartment. The detectives stated"they came through the attic opened the door robbed you." any information on code violations and legal advice?

Then the police know who did it, and have arrested the people responsible??

Were you robbed or was it a burglary?

The perpetrators entered your apartment through a passageway in your closet? Were you aware that one could enter your apartment in that manner?

You 'can' sue anyone; whether you will win isn't always easy to predict. Small Claims will award you the filing fee if you win. Your landlord may defend himself by saying you knew the attic was open and should have locked a certain door, etc. As you describe the access it's confusing. But you seem to have a reasonable shot at a claim. Take pictures now of the way they got in. What has been done about barring access?

I sincerely doubt if you the landlord can be held liable. But if he were aware of unsecured access to your apartment and did nothing to warn you or secure, there MIGHT be a case.

But I echo Chuck's question, what are the police doing? Also, what about your renter's insurance?

The issue is you can sue for a loss.
And a issue on wording, if you had a theft , they broke and entered, if you were there and they took things from you personally you were robbed, you can not be robbed if you were not home, ** fine point of the criminal act they did.

But if the police found the person who did ,it, and you got all your belongings back, and/or insurance paid the difference you also have no case, you can only sue for the amount of the loss.

How did the police know or prove this happened the way you said ?

Once notified, has the landlord came back and put locks on the attic access ?
