The father wants custody of his daughter but the mother won't even let him see her. The mother will call him saying crazy stuff like "I hope your daughter get raped", I as his girlfriend would like to know what can he do to get full custody of his child? He and I both believe the mother to be unstable emotionally. The only problem is he lives in N. Carolina and she (along with his daughter and her son) lives in S. Carolina. We live in a 2 bedroom apartment and he feels like a jugde will not let her come stay with him, what can he do to get his child?

He has to go to court. What is the custody situation now? What age is the child, can she make her preference known to the court?

It would be worth taping some of those phone calls, they would be evidence in a custody hearing. The size of his apartment is not a bar to custody.

One thing to bear in mind: you are not involved in this. You have no legal standing in this case, and if you get involved, you may weaken his position.

Bear in mind that angry people can say anything as a taunt, meant to punish and aggravate and make someone worry. She may very likely not wish that at all. We can't know if she is a fit mother or not. And the courts know all about words spoken in anger, just as the police know that someone saying 'I want to kill you' doesn't make them a murderer.
