What can I do to get back my son and have custody rights for him my ex filed a restraining order with false acussations against me and someone report him with child protective services I have always been a good mother as I can be for my son and I have a clean record execpt my sons dad have been arrested in the past with domestic violence and child endargement and now due to that restrainig order he got the court decided to leave it for five more years without giving me rights to see my son what can I do *** help me ?

You need to answer many questions here, and you have some unclear sentences (someone report him - who?)(he got the court decided - who?)
Please say
1- What state
2- When you had the child
3- When his father went to prison, and when he got out
4- Is the 'ex' someone you were married to, and when
5- Is the ex the one with custody at the moment
6- Is the child's dad living with you

In orange county ca
I had him since he's been born until January 2 2011
He got arrested in July 22 of 2006 for domestic violence and child endargement
He got bail out the next day from his parents
We never got married
Now he got custody of my son due to the restraining order
We don't live together
Now I don't know what is the next step I should do or what forms tofile to get back my son to my custody

I HAD HIM SINCE HES BEEN BORN UNTIL JANUARY 2 2011
HE GOT ARRESTED IN JULY 22 OF 2006

You had custody of your son until January of this year, when a restraining order was filed against you, giving custody to the father?

Before that, did you have a court order giving you primary physical custody?

What was alleged in the application for this restraining order?

Was the restraining order issued without prior notice to you and opportunity for you to tell your side of the story?

In the restraining order, was there notice of another hearing at which time you would be able to tell your side of the story?
