What about at 13? Just how much weight is there? My son wants to come live with me, but I am not fond of the idea of splitting up siblings. At the same time though my son is miserable with his mother. How much hope should I give him?

First its not a good idea to piggyback your question on someone else's. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread.

Second, ANY question on law needs to include your general locale as laws vary by area.

But at 13 I wouldn't imagine the court would give much weight.

At 13 some courts may allow him to testify but it is not at all what they use. You will have a chance to show the court it would be in the child's bests interest. The mother will have the chance to show why the child should stay with her.

The judge will look at all of the evidence to rule

Thank you for your help. Unfortunately my son claims to be in misery, and this doesn't help the cause much. I can't in any honesty claim my ex has any faults as a mother. I guess it's a lost cause and would only add to strife. Thanks for the answers

WHY does your son claim to be in misery. If mom is not a bad mother, maybe if you determine the cause, you can find some way to help.
