View Full Version : Part time resident in multiple states, husband and wife living separately

Dear Experts,

I needed your help in determining which forms to file for tax purposes for my parents. This is their timeline in the US for 2010:

Father:

NY: Aug01-Aug10 (Stayed at my brother's house)
OH: Aug10-Nov30 (Stayed at my Aunt's house)
MI: Dec01-present (Started working in MI)

Mother + my siblings(both dependents):

NY: Aug01-Aug10 (Stayed at my brother's house)
OH: Aug10-Jan15(2011) (Stayed at Aunt's house)
MI: Jan15(2011)-present (Housewife in MI)

I would say in OH, and MI they established some form of domicile as they got State IDs, licenses, and brother went to public school in those places. In NY it was more of an interim stay. My sister, is 23 yr old, unmarried, not working, and living with parents so I have put her down as a dependent. Parents and siblings have greencards.

I was going to file the following forms:

1) married filing jointly for the federal tax return.
2) Use Schedule B to show interest income.
2) part time return filing jointly for NY.
3) part time return filing jointly for OH.
4) part time return filing jointly for MI.

I am actually doing these through taxact.com, so I don't know the specific form numbers that will be used. Could you let me know if I am filing the correct forms?

Are your parents US citizens or residents?
They are not required to file state tax return if the income earned while present in the state is less than the state's filing requirements.

Given that they were in NY for only 9 days that hardly seems like residency there. Did they have any income from NY sources during this time (won the lottery perhaps)? If not - they probably don't need to file for NY at all. As for the others - yes, use part-year resident returns for OH and MI.

They are green card holders.

They did not have any income in NY or OH.
