View Full Version : Put lien on property I purchased with receipt and this person resold it 3-1-2011

I am currently suing two folks one for signing over property to me but NOT at the clerks office and another whom purchased that land I filed a lien on. I filed this lien April 16 2010 and I have a receipt with the money order that are dated March 1 2010 and I have a copy of a warranty deed that he gave to a person on march 1 2011 this year that they traded for a truck. I told the person buying the land I had the lien and that I was suing the person that sold it to him. This person postponed the court date then stated he moved from the address he lives at. So I suing the person that purchased the land now and he calls me and threatens to spread rumors if I do not remove the lien which I will not. I will not settle now as I don't take threats lightly any advice? I took a blood drug test 3 or 4 years ago and flunked which means no drugs were detected as I quit in 2003 maybe early 2004 but that would be what he is talking about I think and big deal it is not on this case of my money. Any advice please.

Oh I live in Texas and this is tax lien property I purchased for the first person who did not have the money but refused to go to the county clerks office. He traded a truck with the second party. The second party has now threated to tell rumors on me and I called 911 when and the officer arrived and listened to the second party but stated I am doing the best thing by suing party number 2.

Let me get this straight: you purchased the property from the owner, and are also suing someone who later also purchased the property from that same owner (Let's call this second person the "second purchaser".) What did you receive from the owner when you purchased the property, a deed? If it was a deed, did you record it?

Apparently the owner paid off the taxes with the money he got from you (despite the fact that you say he refused to go into the clerk's office), is this correct? In other words, the property was not sold for taxes, but now belongs to the second purchaser, correct?

If you didn't receive and record a deed, and the second purchaser was ignorant of the transaction between you and the owner, I don't see that you have a case against the second purchaser. Your only remedy, if any, is against the former owner.

So, what sort of rumor is the second purchaser threatening to spread?

Ok what I do is deal in tax lien properties and the first purchaser did ont have the money so I paid the amounts he had on the bid sheets. I got his signature at the attn: ofc that handles the tax deeds on a paper that transferred it to a trust that I was selling adjorning property for a total of 6 acres on water frontage that is one mile by creek to the mouth of the mission river so it never goes dry. What I have done with this persons brother is pay the land off and then when I sell it I give 6% as them being an agent. I can show we have dealt with each other since 2007. When the paperwork was mailed for us to do the transfer (I did not have it signed by a notary) he actually shut the door in my face I called a unit just to make a time line. This was done April 14 and April 16 I put a lien on the property as I cleared it to the (river) and cleared brush off the hurricane fence of the neighbors property as I wanted it clean to look at this is over 600 foot of river frontage.

Cont. He traded the property after I have his signature on transfer to me to another vet with a warranty deed knowing the lien was on the property. So I have now filed suit against the 2nd party and he called threatening to tll me that I need to make this suit disappear or else he will say I use my father a doctor to call in perscriptions as I have been approached by some citizens since the last post. I have gone to the Police and Sheriff as my whole faimily can prescribe I have 2 denist 1 paradonist 1 child phycologist and an old MD in the family so I did not want them dragged into this and have been told not to worry about it by all mentioned. I started this company heard shores a vet helping vets and have worked with the chamber to help with business plan and have sold properties but these guys seem to be in cahoots. I will serve notice in the paper as party number 1 stated he no longer lives where he lives at. Have learned no friends will I purchase from.

Oh and the 2nd purchaser knew that a lien was on the property as I talked to him personally 1 27 2011 when I called a unit to come to the land as the first party was clearing my property the units statd without survey markers that it is civil but I talked to the officers and even told them while talking to party #2 on the phone I have a lien and even told party #1 again after putting fliers on his truck and home and wife's car and mailing one to him last year. State of Texas need not be certified if you did physical work on property with land owner knowledge. I even have a state deputy that helps me clear the land and I pay him 25 an hour upon the sale of the land which I have not paid him for this. I have all the documents stated + the warranty deed that was given to the 2nd party. He was even told by party #1's brother that I have a lien on the place as I put no trepass signs on the place when I was clearing it whne party #1 knew that was going on. Yes party #2 knew about lien

Also please note that in Texas when you purchse property with a warranty deed you purchsae the liens also but the person that sold you the warranty deed has to rep you in court. That is what I am truly after but with this first person threatening me I want the courts to decide as I had informed the 2nd party all the way through about the lien and my process. I was a friend of his fathers and thought I should at least do that but then he decided to turn on me. Yeah he traded the property last year and Iwent to the S.O. and told them the license plate number of the owner of the truck but later found out it was this other vet. He knew and even stated he would take truck back but has not so this is why I am suing him. As I stated the transfer legally was 3-1-2011 so I am within my 30 days of suit. I willnot settle out of court as it seems they intended to do this to me. Why be mad when he knew it was coming?
