View Full Version : Tenants have managed to get a new court date AFTER we requested Warrant for Removal

Ok so the other I was asking anyone if they knew about tenants applying for an order to show cause when after getting our default win as they didn't show up for court, I was worried how long thye'd get the eviction put off and gain more time due to hardship. Today is the day we expected the officer of the court to come serve them with the warrant. We called the court and was told there is now a NEW court date in April so apparently they managed to overturn the default judgement. I am ready to turn everything off and move out. I don't know how they managed to do this given they didn't show up, there's no back rent, its an illegal rental so it can't be that they came up with money, we're not allowed to accept money, its illegal. I don't get it ands don't believe the court is allowing this. What is the point of a court system if a judgement can be overturned by people who abuse the system and milk us for all they can, living in my home for almost a year, almost 10 months of it for free when now we're losing our house because of them and they harass us every night? If the town wants them out, we want them out, why does it have to be so hard to actually get them out??

I see in your other thread (https://www.askmehelpdesk.com/real-estate-law/eviction-illegal-rental-hardship-stay-564372.html) that you have been told you cannot collect money from them because it is an illegal rental. If it were me, I would take the money they give you, pay the power bill with it and hold anything left over to compensate you for what they owe you.

They haven't paid the rent in 9 months, their not giving me a dime at the same time running up the bills to a ludicrous amt I cannot afford

So you have been trying to evict for 9 months, how long did you allow them to live free before you started the eviction?

But yes, people who cheat the system, often know exactly what to say, and what to put down, most likely they will push it for every day they can.

We started trying after 2 months of no rent payment, but we're just homeowners with kids trying to save our house, not professional landlords. After the 2 months, it took months of going through the town attempting to register the property, fire safety inspections, etc. About 4 months later found out it was impossible to register and we couldn't evict for non-payment, it had to be for illegal occupancy. Then unfortunately because I can't afford a lawyer, I sent in the paperwork wrong 2 times to the court so it took an extra 6 weeks. Lucky for the tenants I guess that I'm no expert. The woman faked an injury (my neighbor saw it happen) to avoid court last week and we thought we won by default as they didn't call or show up. Now we have a new court date. I understand why certain tenants should be protected but I'm not a slum lord, I'm just trying to keep my home and their behavior is despicable. Definitely thinking they'll get another couple months here for free
