I been refused in UK under below metioned reasons:-

REFUSAL TO VARY LEAVE or VARIATION OF LEAVE

"You do ot satisfy the requirements for the Immigration Rules for this category and it has been decided to refuse your application for leave to remain under the published Immigration Rules paragraph 62 with reference to 60(ii) and 57(viii) of HC395 (as ameded), ad paragraph 322(5) of HC 395 (as ameded).

BACKGROUND:
- I arrived in the UK on 05 September, 2003 with a student visa valid until 31 October 2004.
- I were granted leave to remain from 26 April 2005 until 30 November 2007 as a Student.
- I was refused in November 2007 on the above mentioned grounds.
- I went to tribunal for appeal and my appeal was dismissed on 28th February, 2008.
- I came back to Pakistan Voluntarily on 23 March, 2009.

I NEED THE ANSWER OF THE FOLLOWING QUESTIONS??
1. HOW LONG I AM BAN FOR UK UNDER 322(5) IMMIGRATION RULES?
2. IS THERE ANY EFFECTS ON MY PARTNER'S APPLICATION IF SHE APPLY FOR UK STUDENT VISA, INCLUDING ME AS DEPENDENT?

ANYONE!! Help would be really appreciated, Many Tahnks

I can't answer #1 BUT...

As far as #2 YOU aren't getting in on your own OR as a dependent since you have been refused for the above reasons. Banned is banned for whatever the duration actually is. And you have to be married or a child to be a dependent even then.

But it probibly won't affect their getting in. Assuming it gets approved in the first place.

Thanks smoothy for your answer, but there must be number of years I am ban for? I AM STILL CONFUSED AS I GOT DIFFERENT STATEMENTS FROM 3 SOLICITORS. First I rang today one of UK Immigration Lawyer, he said I am ban for a year, I am not sure yet, as couple of solicitors in Pakistan told me that the ban is for 10 years?

Me and my partner are planning to apply this year. SO ANYONE IF YOU KNOW THE ANSWER? BUNDLE OF THANKS

Sorry, but you will have to inquire with them for that. I don't know what the standard ban time in the UK is. If you can contact the British Embassy they can provide you a better answer.

One year seems too short for a ban. I think its 10 years before you can try again in the USA. But I can't assume the UK would use that same number.

The ban is a year but the chance to get new visa even dependent visa is very slim because you cannot demonstrate evidence to ties to your home country at all.

Thanks lawanwadee, but most of my family members including my parents living here permanently as well as my wife got 17% shares in a family business in Pakistan, its our family business setup, the company yearly turnover is around 330,000.00US$. I got the paperwork as well as the statement of her shares. So do you think keeping these facts, have you still got the chances of approval of our visas? Thanks for sharing
