View Full Version : SOL is 10 years in RI, I am being taken to court on 11 year old account

Hi,
I'm being sued in court on an account that had it's last activity in October 2000 and charged off in April 2001. I've tried to get proof of my last payment, but JC Penney can't send me anything in writing, they have just told me over the phone that is the information they have on file, well they sold the account to GE Financial in April 2001, I spoke to them, they have the same last payment information and said they sold that account in July of 2006. I am being sued in court by a co. Arrow financial and ersolutins for the JC Penney account, All I have is verbal word from JC Penney and GE Fincancial that the account had no activity since 2000. How do I represent myself in court if even I don't have physcial evidence that the account has reached SOL, I don't have anything on my credit report because it came off after 7 years. But like I said in RI the SOL is 10 years.

Why are you asking the same question over and over. This was already answered. Please do not keep starting new threads. You will just have to go to court and ask for a dismissal on the grounds of the SOL expiring. They will then need to prove that the account had activity within the SOL.

Thank you Scott. Didn't mean to upset anyone. I'm not a lawyer and have never been to court before so for me it is a scary situation.
