View Full Version : Fired for getting sick, Should I be concerned?

I am getting fired from my job, for calling into work sick. I realize that they can fire me for absolutely no reason at all, but then my boss asked me to stay at my job and work for the next two weeks. I asked for and they have denied my request for documentation from them on my termination. They stated that they are not legally obligated to do so. Something about this sitaution seems very fishy. Should I be concerned?

If you stay for the two weeks is your status still "fired" or would you be allowed to resign? I'd ask that FIRST. On one hand you may or may not be able to collect Unemployment. On the other, why walk out with a bad reference?

They are not obligated to give you anything in writing.

I don't see anything "fishy" here. What part of what they are doing seems "fishy" to you?

I think that they may be trying to keep me from getting unemployment. If I stay the two weeks I am still fired. It seems odd that they would fired me and still ask me to stay on for two weeks.

I agree. You're NOT being fired. You're being laid off. Tell the unemployment people exactly what you're telling us. If you can get documentation of it, I would.

At will employment means they can toss you out for any reason and you can up and leave for any reason.

If you are getting sick because of the work environment, that sickness is covered by Workers Compensation. In short, no they can't fire you under those conditions. Now, can they eliminate the position-Yes.

What exactly is making you sick, has it been proven ?

You can't just not go to work and claim it is something there, you will have to prove it

Are you sure the Family and Medical Leave Act (http://en.wikipedia.org/wiki/Family_Medical_Leave_Act)doesn't apply? Or your state FMLA? How many employees does your company have?
