My Husband was arrested for trafficking in Alabama and was on probation.They violated his probation but he has not been indicted or found gulity on the trafficking,he has been in jail for a year waiting to go to prison on violation of probation,for a case he has not even been indicted on.Can he get probation reinstated.

Do I have this right? He was arrested for trafficking. He doesn't have to be indicted. Did he enter a guilty plea? I don't understand how, if the case has not been heard, he has been placed on probation.

For example, I wouldn't get indicted for driving while intoxicated but I would be fined/sentenced/found guilty.

Now he's violated probation.

He's in jail waiting to go to prison to serve his original term (if he had not received probation).

Do I have it right?

Can he get probation reinstated.Hello t:

It appears that there's been a decision NOT to reinstate him.. However, if he had an attorney, he might get another hearing...

No he didn't enter a gulity plea. He was already on probation when he got arrested for trafficking.

HE WOULDN'T BE ON PROBATION IF HE WASN'T FOUND GUILTY OR DIDN'T ENTER A GUILTY PLEA. YOU DON'T GET ARRESTED AND PUT ON PROBATION.

And please don't type in caps - it's the equivalent of shouting at ms.
