I am starting an online home auction website where people can privately auction their homes. I am not an agent or a broker. Can you tell me the legal implications?

This depends on many factors from the Country/State where youj are advertising and selling to local licensing to insurance, corporate structure and so forth.

You need an Attorney to look at this for you.

Ever wonder why there aren't any actual auction web sites other than eBay? There are a lot of pretend, inverted auction knock-offs that simulate the high-pressure feeling of auctions without actually being a normal auction. This is because eBay (very intelligently) has patented the online auction process. Aside from any legal issues you might have regarding home ownership, eBay will most likely order a cease and desist. This is especially because eBay already supports real-estate auctions.

There are many local and national house auction sites, they hold them about every couple of months here in Atlanta.

Some of the issues, do you have a auction license, and the possible issue do you hold real estate license in every state where property may be sold.

So is going to be allowed to list property, just agents, or are people also going to list.

Who is going to be responsible for home closing, transfers of funds. Are you also going to open a escrow company to handle all the funds. Will you be bonded if you are handing their money.

What are you going to require for proof they have legal right to sell the home.

I just researched and there ARE other on-line actual auction sites (unless I'm misunderstanding your use of the word "actual"). Where are you reading about pretend, inverted sites?

My niece actually works for a real estate auction site in Florida - but it's limited to the State of Florida.

NOTE: Now that this person has opened a second thread on the same subject and called me a loser (in a reddie) I'm out of here. Let him figure it out for himself.

I wanted to specify that I was in ONTARIO CANADA as I was getting reply's about Florida whih would be of no help. But thanks.
