My estranged husband is only felony shock probation for injury to a child for 10 years. He did 4 months in tdcj to scare him and he was released on shock probation. 10 months after getting out he reported a video of child abuse that happened 7 months earlier which he never turned in so he could use it for blackmail. Now he is being charged with injury to a child-failure to report. What are the chances of him actually staying in prison this time even with having a lawyer? We are in tx by the way.

Texas LOVES to lock people up. I'd say it's 10 to 1 he gets time.

Yes, Texas is not where you want to be with injury to child.
And to be honest, he keep video of it also, I am not sure I don't want him locked up, so that sort of shows chances there.
But he was "shocked" but that did not really scare him, he keep a tape, planned on using it for blackmail ( another crime) and he did not destroy it, or report it.
Then on gods green earth why did he give it to them, ( what it sounds like) was it for the blackmail?
But yes I would say he will do some time, if not a year or two at least.
